Terms of Service

1. Introduction and Acceptance of Terms

Welcome to Sports Cappers Leaderboard, LLC ("SCL," "Sports Cappers Leaderboard," "we," "our," or "us").

These Terms of Service ("Terms") govern your access to and use of the Sports Cappers Leaderboard website, applications, services, features, and related technology (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you create an account, enable Creator Features, or otherwise continue to use the Platform, you acknowledge that you have read, understood, and agreed to these Terms.

Certain features of the Platform may require additional acknowledgements or agreements. In the event of any conflict, those additional terms shall govern solely with respect to those specific features.

Please also review our Privacy Policy, Responsible Gaming Policy, and Refund Policy, each of which is incorporated into these Terms by reference to the extent applicable. These policies explain additional rights, responsibilities, and practices relating to your use of the Platform.

Definitions

  • Platform means the Sports Cappers Leaderboard website, applications, services, features, databases, and related technology.
  • User means any individual or entity that accesses, browses, registers for, or otherwise uses any portion of the Platform.
  • Content means information, picks, statistics, text, graphics, images, videos, comments, or other materials submitted, displayed, or otherwise made available through the Platform.
  • Creator means a User who elects to enable Creator Features.
  • Creator Features means features allowing Users to publish sports picks, maintain public profiles, participate in leaderboards, connect approved third-party storefronts, or otherwise publicly participate as sports content creators.
  • Store Integration means any approved third-party platform or service that may be connected to a Creator's profile, including subscription platforms or similar services approved by SCL.

2. About Sports Cappers Leaderboard

Sports Cappers Leaderboard is an online platform designed to help Users discover, evaluate, and follow sports content creators through transparent historical performance information, creator profiles, analytics, and links to approved third-party platforms.

The Platform may include:

  • public creator profiles;
  • verified historical performance records;
  • leaderboards;
  • creator statistics and analytics;
  • awards and recognition programs;
  • Store Integrations;
  • community features; and
  • additional features introduced by SCL from time to time.

Sports Cappers Leaderboard is not:

  • a sportsbook;
  • a gambling operator;
  • a bookmaker;
  • a sports wagering platform;
  • a payment processor;
  • a subscription management platform; or
  • a financial or investment advisory service.

Unless expressly stated otherwise, purchases of subscriptions, memberships, premium content, or other products offered by Creators occur through independent third-party platforms governed solely by those platforms' terms and policies.

Nothing on the Platform constitutes legal, financial, tax, investment, or professional advice.

3. Eligibility and User Accounts

You may use the Platform only if:

  • you are at least eighteen (18) years old (or the age of majority in your jurisdiction, if greater);
  • you possess the legal capacity to enter into these Terms; and
  • your use of the Platform complies with applicable law.

Certain features require account registration.

If you create an account, you agree to:

  • provide accurate information;
  • maintain current account information;
  • maintain the confidentiality of your login credentials;
  • promptly notify SCL of unauthorized access;
  • be responsible for activity occurring under your account.

Users may not:

  • create accounts using false identities;
  • impersonate another individual or organization;
  • create multiple accounts for deceptive purposes;
  • transfer accounts without SCL's consent; or
  • share account credentials.

SCL reserves the right to suspend or terminate accounts that violate these Terms or threaten the integrity, security, or operation of the Platform.

4. Using the Platform

Users agree to use the Platform only for lawful purposes.

Users shall not:

  • violate applicable law;
  • interfere with the operation of the Platform;
  • scrape, harvest, or systematically collect Platform data without authorization;
  • upload malicious software;
  • manipulate Platform records or statistics;
  • impersonate other Users;
  • infringe intellectual property rights;
  • engage in fraudulent or deceptive conduct; or
  • otherwise misuse the Platform.

SCL reserves the right to investigate suspected violations and take any action reasonably necessary to protect the Platform and its Users.

5. Creator Features

Users who elect to enable Creator Features become subject to the additional provisions of this Section.

Creator Features may include, without limitation, public creator profiles, publication of sports picks or other content, participation in leaderboards, performance tracking, analytics, verification programs, awards, Store Integrations, and other creator-focused functionality made available by SCL from time to time.

Creator Representations and Responsibilities

By enabling Creator Features, you represent, warrant, and agree that:

  • all information you submit to the Platform is accurate, current, and not misleading;
  • you own or otherwise possess all rights necessary to submit and publish your content through the Platform;
  • your content does not violate applicable law or infringe the intellectual property, privacy, publicity, contractual, or other rights of any third party;
  • you will not knowingly submit false, manipulated, fabricated, or misleading records, statistics, or other information; and
  • you will comply with these Terms and all applicable laws and regulations.

You remain solely responsible for all content you submit to the Platform. Creators are solely responsible for the accuracy, legality, completeness, and timeliness of the content they submit.

Ownership of Creator Content

As between SCL and the Creator, the Creator retains ownership of all content submitted to the Platform.

By submitting content through the Platform, the Creator grants SCL a worldwide, non-exclusive, royalty-free, transferable, sublicensable (solely as necessary to operate the Platform), license to host, reproduce, display, distribute, promote, archive, and modify such content solely as reasonably necessary for formatting, technical, operational, promotional, or Platform-related purposes.

This license continues only for so long as reasonably necessary for SCL to operate, maintain, promote, archive, or improve the Platform, subject to applicable law.

Creator Profiles and Recognition

SCL may, in its sole discretion:

  • verify Creator identities or profiles;
  • award, suspend, or revoke verification badges;
  • establish, modify, or discontinue awards, achievements, rankings, or other recognition programs;
  • determine eligibility for promotional opportunities or featured placement;
  • archive or hide inactive Creator profiles; and
  • establish reasonable participation requirements for Creator Features.

Verification badges, awards, rankings, and similar recognition are provided solely as Platform features and do not constitute an endorsement, certification, recommendation, or guarantee of any Creator or future performance.

Suspension of Creator Features

To preserve the integrity of the Platform, SCL reserves the right to suspend, restrict, remove, or terminate Creator Features, or remove, edit, hide, or restrict access to Creator content, where SCL reasonably believes doing so is appropriate, including where content or activity:

  • violates these Terms;
  • violates applicable law;
  • infringes the rights of another person or entity;
  • is fraudulent, deceptive, manipulated, or materially misleading;
  • threatens the integrity of Platform statistics or leaderboards; or
  • otherwise presents legal, operational, reputational, or security concerns for SCL or its Users.

Nothing in this Section obligates SCL to monitor, review, investigate, or verify Creator content or activity.

6. Store Integrations, Third-Party Services, and Affiliate Relationships

The Platform may permit Creators to connect approved third-party platforms, storefronts, subscription services, social media accounts, websites, or similar services ("Store Integrations") to their Creator profiles.

Participation in any Store Integration is voluntary unless otherwise specified by SCL.

By utilizing a Store Integration, the Creator acknowledges and agrees that:

  • additional onboarding, verification, or approval steps may be required before the integration becomes active;
  • SCL may require participation in approved affiliate, referral, or similar programs as a condition of supporting certain Store Integrations;
  • SCL may receive affiliate commissions, referral compensation, or similar payments in connection with Users' interactions through the applicable third-party platform;
  • affiliate tracking methods, attribution rules, recurring commission elections, commission percentages, payment terms, and other program requirements are established solely by the applicable third-party platform and may change at any time; and
  • SCL may add, modify, suspend, or discontinue supported Store Integrations at its discretion.

Users acknowledge that all purchases, subscriptions, memberships, payments, refunds, cancellations, customer service, and other transactions conducted through third-party platforms are solely between the User and the applicable third-party provider.

SCL does not control and is not responsible for the products, services, pricing, payment processing, billing practices, refund policies, customer support, or other activities of third-party platforms.

7. Leaderboards, Statistics, and Automated Grading

The Platform is designed to provide historical performance information relating to sports content creators.

To support this objective, SCL may utilize automated grading systems, third-party data providers, manual review, or any combination thereof to calculate sports pick outcomes, historical records, statistics, rankings, leaderboards, awards, and other performance information.

Although SCL strives to maintain accurate historical information, Users acknowledge that grading errors, data delays, postponed or cancelled sporting events, technical failures, third-party data issues, human error, or other inaccuracies may occur.

Accordingly, SCL reserves the right to:

  • manually correct grading outcomes;
  • modify historical records or statistics;
  • recalculate rankings or leaderboard positions;
  • remove duplicate, manipulated, fraudulent, or inaccurate records; and
  • determine the official records, statistics, rankings, and leaderboard positions displayed on the Platform.

As such, leaderboard positions and statistics may change retroactively due to corrections or recalculations. SCL's determination of official Platform statistics, records, rankings, and leaderboard results shall be final. Nothing in this Section obligates SCL to correct every error or dispute regarding historical statistics or leaderboard positions. Sporting event schedules, scores, odds, betting lines, player statistics, and other sports data displayed on the Platform may be obtained from independent third-party data providers. SCL does not warrant the accuracy, completeness, timeliness, or continued availability of such information and is not responsible for errors, omissions, delays, or interruptions attributable to third-party data providers.

Historical statistics displayed on the Platform may differ from records maintained by Creators or third-party platforms.

8. Performance Information; No Reliance

The Platform provides historical performance information, statistical data, rankings, leaderboards, creator profiles, and related content for informational purposes only.

Users acknowledge and agree that:

  • historical performance does not guarantee or predict future performance;
  • a Creator's historical success, verification status, awards, leaderboard position, or other recognition should not be interpreted as a guarantee of future results;
  • SCL does not recommend, endorse, certify, or guarantee any Creator, sports pick, wagering strategy, subscription service, or other product or service displayed on the Platform;
  • Users are solely responsible for conducting their own independent evaluation of any Creator before purchasing products, subscriptions, memberships, or other services;
  • SCL does not independently verify every pick, record, or representation made by Creators;
  • Users should not rely exclusively upon information presented through the Platform when making purchasing or wagering decisions; and
  • Users should independently verify any information they consider material before purchasing products or services from a Creator; and
  • all purchasing, wagering, and financial decisions are made solely at the User's own risk.

Nothing displayed on the Platform constitutes personalized wagering advice or a recommendation that any User place a particular wager.

While SCL strives to maintain accurate information, SCL makes no representation or warranty that historical records, rankings, statistics, grading results, or other information displayed on the Platform are complete, accurate, current, or error-free.

SCL does not guarantee that any Creator will continue to publish content, maintain a subscription service, or remain active on the Platform or any third-party platform.

Nothing displayed on the Platform constitutes legal, financial, tax, investment, gambling, or other professional advice, nor should any Creator's content be interpreted as personalized wagering advice or a recommendation that any User place a particular wager.

9. Acceptable Use & Responsible Gaming

Users agree not to use the Platform in any manner that:

  • violates applicable law or regulation;
  • infringes the intellectual property or other rights of another person or entity;
  • interferes with the security, operation, or availability of the Platform;
  • introduces viruses, malware, or other malicious code;
  • scrapes, harvests, or systematically collects Platform data without SCL's prior written authorization;
  • attempts to circumvent security measures or gain unauthorized access to the Platform;
  • manipulates Platform statistics, rankings, or historical records;
  • interfere with another User's use or enjoyment of the Platform;
  • impersonates another person or entity;
  • submits false, misleading, or fraudulent information; or
  • otherwise abuses or misuses the Platform.

SCL reserves the right to investigate suspected violations and take any action reasonably necessary to protect the Platform, its Users, and its business.

Creators remain solely responsible for all content submitted to the Platform, whether created personally or generated with the assistance of artificial intelligence or similar technologies.

Responsible Gaming

While SCL encourages responsible gaming practices, Users acknowledge that sports wagering involves financial risk. Users should wager only amounts they can afford to lose, should never wager money needed for essential living expenses, and remain solely responsible for their own wagering decisions. Historical performance, rankings, verification status, awards, and other information displayed on the Platform do not guarantee future results. Users are encouraged to comply with applicable gambling laws in their jurisdiction and review SCL's Responsible Gaming Policy for additional information and resources.

10. Intellectual Property

Except for content submitted by Users, the Platform and all software, source code, databases, text, graphics, logos, trademarks, service marks, designs, photographs, videos, compilations, user interfaces, functionality, and other materials made available through the Platform (collectively, "SCL Content") are owned by or licensed to SCL and are protected by applicable intellectual property and other laws.

Subject to these Terms, SCL grants Users a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for its intended purposes.

Except as expressly permitted by these Terms or with SCL's prior written consent, Users may not:

  • copy, reproduce, distribute, publish, modify, create derivative works from, publicly display, publicly perform, reverse engineer, decompile, or otherwise exploit SCL Content;
  • use SCL trademarks, logos, branding, or other proprietary materials;
  • remove or alter copyright, trademark, or other proprietary notices; or
  • use Platform content for commercial purposes without authorization.

Nothing in these Terms transfers ownership of any intellectual property rights from SCL to any User.

SCL welcomes comments, suggestions, ideas, feature requests, and other feedback regarding the Platform ("Feedback"). By submitting Feedback to SCL, you acknowledge and agree that SCL may use, modify, implement, reproduce, distribute, or otherwise exploit such Feedback for any lawful purpose without restriction or obligation to provide compensation, attribution, or other consideration to you. No implied licenses are granted except as expressly set forth herein.

11. Suspension and Termination

SCL reserves the right, at any time and in its sole discretion, to suspend, restrict, disable, or terminate access to the Platform or any portion thereof, with or without notice, if SCL reasonably believes that a User has:

  • violated these Terms;
  • violated applicable law;
  • infringed the rights of another person or entity;
  • engaged in fraudulent, deceptive, abusive, or unlawful conduct;
  • compromised the security or integrity of the Platform; or
  • otherwise engaged in conduct that SCL determines may adversely affect the Platform, its Users, or its business.

SCL may also suspend, remove, archive, or discontinue Creator Features, Store Integrations, leaderboards, historical records, or other Platform functionality at any time.

Termination or suspension does not relieve any User of obligations or liabilities accrued prior to such termination.

Sections intended by their nature to survive termination, including intellectual property provisions, disclaimers, limitations of liability, indemnification obligations, dispute resolution provisions, and any accrued rights or obligations, shall survive termination of these Terms.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCL DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, OR THAT THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION OR ERROR.

WITHOUT LIMITING THE FOREGOING, SCL DOES NOT WARRANT THAT:

  • THE PLATFORM WILL BE AVAILABLE AT ANY PARTICULAR TIME;
  • THE PLATFORM WILL BE FREE FROM ERRORS, DEFECTS, OR INTERRUPTIONS;
  • PLATFORM CONTENT OR HISTORICAL INFORMATION WILL ALWAYS BE COMPLETE, ACCURATE, OR CURRENT;
  • ANY CREATOR WILL REMAIN ACTIVE ON THE PLATFORM OR ANY THIRD-PARTY PLATFORM; OR
  • ANY THIRD-PARTY SERVICE WILL CONTINUE TO BE AVAILABLE OR SUPPORTED.

NO INFORMATION OR STATEMENT MADE BY SCL SHALL CREATE ANY WARRANTY NOT EXPRESSLY SET FORTH IN THESE TERMS.

SCL does not warrant that the Platform, including any files or other content made available through the Platform, will be free from viruses, malware, or other harmful components.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCL, ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS, REGARDLESS OF THE LEGAL THEORY ASSERTED AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF SCL ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:

  • (a) ONE HUNDRED U.S. DOLLARS (US $100); OR
  • (b) THE AMOUNT, IF ANY, PAID DIRECTLY TO SCL BY THE USER DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE LIMITATIONS SET FORTH IN THIS SECTION SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW, EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

14. Indemnification

You agree to defend, indemnify, and hold harmless SCL, its affiliates, owners, officers, directors, employees, contractors, agents, licensors, successors, and assigns from and against any and all claims, demands, actions, proceedings, liabilities, damages, judgments, settlements, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • your use of the Platform;
  • your violation of these Terms;
  • your violation of applicable law;
  • content you submit or publish through the Platform;
  • your infringement or alleged infringement of any intellectual property or other rights of any third party; or
  • your negligent, fraudulent, or wrongful acts or omissions.

SCL reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate fully with SCL in the defense of such matter.

15. Dispute Resolution; Governing Law

These Terms and any dispute arising out of or relating to these Terms or the Platform shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.

The parties agree to first attempt in good faith to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Platform through informal discussions. If the dispute cannot be resolved informally within thirty (30) days after written notice by either party, either party may initiate binding arbitration as provided in this Section.

Except where prohibited by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its applicable rules then in effect.

The arbitration shall be conducted in Dallas County, Texas, unless the parties agree otherwise. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms.

Nothing in this Section shall prevent either party from seeking temporary, preliminary, or permanent injunctive or other equitable relief from a court of competent jurisdiction where necessary to protect its intellectual property, confidential information, proprietary rights, or other interests pending the final resolution of the dispute through arbitration.

To the fullest extent permitted by applicable law, each party knowingly and voluntarily waives any right to a trial by jury. Arbitration shall be conducted solely on an individual basis. No class action, collective action, representative action, consolidated proceeding, or private attorney general action shall be permitted.

Judgment upon the arbitration award may be entered in any court having jurisdiction.

16. Changes to the Platform and these Terms

SCL continually develops, improves, and updates the Platform. Accordingly, SCL reserves the right, at any time and without liability, to add, modify, suspend, discontinue, or remove any feature, functionality, service, Creator Feature, Store Integration, leaderboard, statistic, or other aspect of the Platform.

SCL may also revise these Terms from time to time. When material changes are made, SCL will update the "Last Updated" date at the beginning of these Terms and may provide additional notice where required by applicable law.

By continuing to access or use the Platform after revised Terms become effective, you agree to be bound by the updated Terms. If you do not agree to the revised Terms, you must discontinue your use of the Platform.

17. General Provisions

These Terms constitute the entire agreement between you and SCL regarding the Platform and supersede all prior or contemporaneous understandings relating to the subject matter herein.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and any failure by SCL to enforce any right or provision shall not constitute a waiver of such right or provision.

You may not assign or transfer your rights or obligations under these Terms without SCL's prior written consent. SCL may assign or transfer these Terms, in whole or in part, without restriction in connection with a merger, acquisition, corporate reorganization, sale of assets, financing transaction, or by operation of law.

Nothing in these Terms creates any partnership, joint venture, agency, employment, fiduciary, or other similar relationship between SCL and any User.

The section headings contained in these Terms are provided solely for convenience and shall not affect the interpretation of these Terms.

These Terms shall be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.
